초록

본 연구는 저작권법 제24조의2의 도입 취지에 맞추어 공공저작물인 정부간행물을 자유롭게 이용할 수 있도록 기록관리 과정에서 저작권정보를 관리하는 방안을 제안하기 위한 것이다. 이를 위하여 중앙행정기관의 기록관리, 정부간행물담당자 및 처리과의 정부간행물 간행경험이 있는 업무담당자 17명을 대상으로 2022년 4월 4일 ~ 6월 13일까지 이메일 면담을 진행하여 정부간행물의 저작권정보 생산 및 관리현황과 문제점을 파악하였다. 이를 기반으로 첫째, 공공저작물에 공공누리 1 유형 적용을 의무화하도록 저작권법을 개정할 것, 둘째, 저작권정보 생산 및 관리의 효율을 위하여 기관 내 정부간행물 저작권정보관리 협업체계를 구축할 것, 셋째, 원저작자정보, 저작권자, 저작권 보호기간, 저작재산권 양도여부, 공공저작물 여부, 공공저작물 미적용사유 등 공공저작물의 저작권정보를 업무관리, 기록관리, 영구기록물관리시스템을 통하여 관리할 것, 넷째, 정부간행물 발간등록번호 신청과정에서 공공저작물 저작권정보를 제공하여 발간과 동시에 국가기록원에서 원문공개서비스가 이루어지도록 할 것 등을 제안하였다.

Abstract

This study aims to suggest measures for handling copyright information on government publications during records and archives management to use them freely as public works according to Article 24-2 of the Copyright Act in Korea. Through email interviews with 17 records managers, persons in charge of government publication management, and government staff with experience in production from April 4 to June 13, 2022, this study determined the current situations and problems related to producing and managing copyright information on government publications. Based on the interview findings, this research suggested the following. First, Article 24-2 of the Copyright Act must be revised to apply the Korea Open Government License (KOGL) type 1 mandatorily to all public works. Second, a cooperative system for managing copyright information on government publications should be established to improve their production and management effectiveness. Third, copyright information, such as authors, copyright holders, copyright duration, information on the copyright property transfer, public works status, and reasons for nonpublic works, must be managed through records and archives management systems. Fourth and last, information on public works must be provided during the registration number application for government publication so that everyone can access the full texts of the publications on the National Archives of Korea website.

The archival content listed arbitrarily makes it difficult for users to efficiently access the records of major economic policies, especially given that they use it without understanding the required period and context. Using the text mining techniques in the 30-year economic policy direction from 1991 to 2021, this paper derives economic-related keywords and changes that the government mainly dealt with. It collects and preprocesses major economic policies’ background, main content, and body text and conducts text frequency, term frequency–inverse document frequency (TF-IDF), network, and time series analyses. Based on these analyses, the following words are recorded in order of frequency: “job(일자리),” “competitive(경쟁력),” and “restructuring(구조조정).” In addition, the relative ratio of “job(일자리),” “real estate(부동산),” and “corporation(기업),” by year was analyzed in terms of chronological order while presenting major keywords mentioned by each government. Based on the results, this study presents implications for developing and broadening the area of archival information services related to economic policies.

ISO 30301 기록경영시스템 표준 제정으로 인해 기록관리가 경영적 차원에서 추진될 수 있는 표준체계가 마련되었지만, 인증을 받은 기관은 극소수이며 알려진 사례도 많지 않다. 이 연구의 목적은 ISO 30301 표준 인증을 획득하고자 하는 공공기관에 적합한 기록경영시스템을 구축할 수 있는 필수 요건을 제시하며, 실무적으로는 우수한 성공 사례를 통해 인증 관련 제반 사항을 숙지하여 표준을 도입하는 데 도움이 되고자 한다. 이를 위해 먼저 인증을 획득한 공공기관 및 지방자치단체의 출자⋅출연기관의 사례와 인증기관을 조사하여 분석하였다. 정보공개청구를 통한 내부문서 분석을 진행하였고, 공공기관 직원 4명과 인증기관 심사원 1명에 대한 인터뷰를 통해 인증심사 과정을 경험한 담당자 개인의 노하우와 전문지식을 포착하였다. 사례연구를 통해 인증을 획득하려는 기관이 효과적으로 인증을 획득할 수 있도록 1단계에서 5단계까지 수행 범위를 나누어 ‘ISO 30301 표준 인증 프로세스’를 제시하였다. 마지막으로 이를 토대로 인증을 효과적이고 실질적으로 획득하는 방안을 5가지로 제안하였다.

Abstract

Although the ISO 30301 Management Systems for Records (MSR) Standard has established a standard system for records management to be promoted at the management level, only a few institutions have been certified, and there are few known cases. The purpose of this study is to present essential requirements for the establishment of MSR suitable for public institutions that want to acquire ISO 30301 standard certification, and through excellent cases of success in practice, various matters related to certification were used to help in the introduction of the ISO 30301 standard. In this study, cases of certified public institutions, local government funding agencies, and certification bodies (CB) were investigated and analyzed. In addition to the analysis of internal documents obtained through information disclosure requests, interviews were conducted with four public agency employees and one certification body auditor to capture the know-how and expertise of the individuals in charge who went through the certification screening process. Through the case study, the scope of the performance was divided into 1 to 5 stages so that organizations that want to acquire the certification can effectively obtain a certification, and the ISO 30301 Standard Certification Process was presented. Lastly, five ways were proposed to ensure that certification could be obtained effectively and practically.
